Play Safety
Duneshot is a beach game. You throw or roll a soft-shelled ball toward a hole in the sand. Read this before you play. This notice applies to anyone who uses a Duneshot set, including guests and children.
Before you play
- Play on open sand with plenty of room. Keep clear of people, children who are not playing, pets, wildlife, vehicles, roads, docks, rocks and water hazards.
- Check the area for glass, trash and uneven ground. Dig the hole away from walkways and other beachgoers, and fill it in when you leave.
- Follow the rules of the beach, park or property where you play. Get permission where it is required.
- Check the ball and set before each use. Stop using any part that is cracked, torn or broken.
While you play
- Throw or roll toward the hole only. Never throw at a person or animal.
- Adult supervision is required for children. Adults decide whether a child is ready to play.
- Do not play in crowds, near water you cannot see into, in high wind, or in heat that makes you feel unwell. Drink water and use sun protection.
- Do not play if you have been drinking alcohol to the point that it affects your judgment or coordination.
Assumption of risk
Any physical activity carries some risk of injury, such as strains, falls, sunburn or being struck by the ball. By using Duneshot, you accept those risks for yourself and for any child you supervise. You agree to use the product as intended and to follow this notice. To the extent the law allows, you release Arcadia Consulting, LLC (formerly 312 Productions NW LLC), a Washington limited liability company, doing business as Duneshot, from claims arising from your own misuse of the product or your failure to follow this notice. This does not limit any right the law does not let us limit, including for injuries caused by a defect in the product.
Not a signed waiver
This is a notice on our website and product page. It is not a signed waiver. If you organize a game or event for other people, it is your job to tell them about these risks and to follow any rules where you play.
